1. The Sky Travel Competition is open to all UK, Isle of Man, Channel Island and Republic of Ireland residents, aged 18 years or over, Proof of age may be required. Employees (or family members of employees) of any British Sky Broadcasting Group company, companies associated with the Sky Travel Competition and all affiliates of such companies (collectively “the Companies”) may not enter the competition.
2. The Promotion opens 9am on 25th October 2007. Closing Date for entries is 6am on 14th March 2008. All entries must be received by the closing date. You may wish to upload your Travel Competition video earlier than this date as we are not responsible for any delays receiving your Travel Competition video. You will find the general editorial guidelines about how to enter this Competition at www.skycast.com/travel.
The prize for the Sky Travel Competition will be one Sony HDD Handycam® camcorder, model DCR-SR52E. The prize is boxed by the manufacturer for retail in the UK and the winner will receive their prize by post. The camera is supplied with AC adaptor, rechargeable battery pack, remote commander, A/V connecting cable, USB Cable, software/driver and Handycam station. There is no warranty. 3. To take part in the Promotion you need to comply with the Terms and Conditions set out below as well as the SkyCast website Terms and Conditions. You will need to upload your ‘travel’ video(s) before the Closing Date. Unless stated otherwise each accepted video will be automatically entered into this competition. The Promoter does not accept responsibility for network, computer hardware or software failures of any kind, which may restrict or delay the sending or receipt of your video. All videos uploaded via SkyCast are reviewed and any video that is rejected because it does not meet SkyCast Terms and Conditions will not be entered into the Competition and will not appear on SkyCast. Entries must not be submitted through agents or third parties. No responsibility will be accepted for any delay in our systems, which means your Travel Competition video is not received by us before the Closing Data. All Travel Competition videos are time stamped by us at the time we consider them to have been received and any Travel Competition video time stamped after the Closing Date will be considered to have missed the deadline and will therefore be disqualified. If you upload a video by MMS from a mobile phone then you will have to pay 25p your network operator charges.
There will be one winner. The winner will be the person judged to have entered the most entertaining, creative and useful video. Sky will create a shortlist from all the entries received by selecting the videos Sky considers to be the best. Sky will then pass this shortlist to an independent judge who will select the winner based on which video he believes is the best. The independent judge has been appointed by the Promoter and is an expert film maker and will make his own independent decision to determine the winner from the short listed videos. The Judge’s decision on the Winner will be final.
4. The Winner will be notified by email or telephone by 5pm on 28th March 2008.
5. You can submit as many different videos as you wish during the period of the Sky Travel Competition.
6. Other than as set out in paragraphs 7 and 8 below, the SkyCast Usage Policy available at www.skycast.com/info/pgterms shall be applicable to all videos submitted for this Promotion. The Promoter reserves the right to disqualify any entrants and their submissions if they fail to comply with these Sky Travel Competition Terms and Conditions set out herein and the SkyCast Usage Policy.
7. Paragraph 6.3 of the SkyCast Usage Policy shall be deleted and replaced by the following:
“6.3 (a) This 6.3 (a) will apply to the Winner (as defined in paragraph 4 of the Sky Travel Competition Terms and Conditions) of the Sky Travel Competition. From the time you submit your Content to the Service you are giving Sky and any other members of the British Sky Broadcasting Group an exclusive, perpetual, royalty–free, transferable, right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, display, make available to the public, broadcast, transmit the Content by all forms of media now known or later invented throughout the world for the full term of copyright and all reversions, extensions or revisions of such copyright. You waive all moral rights in relation to your Content. You further acknowledge and agree that no royalties or fees are payable for use by Sky of the Content. If you do not wish to give Sky and members of the British Sky Broadcasting Group these rights then do not submit your Content to the Service.
(b) This 6.3(b) applies to all entrants of the Sky Travel Competition except the Winner. From the time you submit your Content to the Service you are giving Sky and any other members of the British Sky Broadcasting Group an exclusive (but only exclusive until after the announcement of the Sky Travel Competition Winner), perpetual, royalty–free, transferable, right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, display, make available to the public, broadcast, transmit the Content by all forms of media now known or later invented throughout the world for the full term of copyright and all reversions, extensions or revisions of such copyright. You waive all moral rights in relation to your Content. You further acknowledge and agree that no royalties or fees are payable for use by Sky of the Content. If you do not wish to give Sky and members of the British Sky Broadcasting Group these rights then do not submit your Content to the Service.”
8. Paragraph 6.4 of the SkyCast Usage Policy shall be deleted and replaced by the following:
“6.4 By submitting your Content to the Service you acknowledge and agree that you are giving Sky, all other members of the British Sky Broadcasting Group and each User a non-exclusive licence to access your Content through the Service and to view such Content as permitted through the functionality of the Service and under these Terms of Use.”
9. There is no cash alternative to the prize and unless agreed otherwise in writing the prize is non-refundable and non transferable.
10. The Promoter reserves the right to substitute the prize for a prize of equivalent or greater monetary value if this is necessary for reasons beyond its control.
11. Except in the case of death or personal injury arising from its negligence or in respect of fraud and so far as is permitted by law, the Promoter and its associated companies and agents exclude responsibility and all liabilities arising from any changes to the prize details beyond Promoter’s control and for any act or default of any third party supplier.
12. The terms and conditions of any third party supplier will apply to the prize where applicable.
13. The Promoter will not be liable if the prize does not reach the Winner for reasons beyond the Promoter’s reasonable control.
14. If the Winner is not able or available, for whatever reason, to accept a prize, then the Promoter reserves the right to award the prize to another participant of the Sky Travel Competition.
15. The Promoter’s decision is final and legally binding on all entrants. No correspondence will be entered into. Entries that do not comply in full with these entry rules and conditions will be disqualified.
16. Details of the prize Winner’s name and county will be available for one month after the Closing Date of the Sky Travel Competition by emailing contactus@skycast.com.
17. The name, county and photograph of the winners may be used by Sky and its associated companies for post-event publicity purposes.
18. The Promoter will keep details of any entry that you make. By entering the Sky Travel Competition you allow us to see and share this information with other Companies including for sales, marketing and market research purposes and to send your information by mail about our products/services.
