Green Shoots Terms and Conditions

We really need you to read these terms and conditions carefully. The small print matters: it protects you and keeps the competition fair. If you submit a film to Green Shoots, you’re saying that you accept all of these terms.

Please see our FAQs page if you have any questions on the terms and conditions.

1. This Competition is open to all UK, Isle of Man, Channel Island, and Republic of Ireland residents, excluding staff of the British Sky Broadcasting Group Plc and any persons involved in the administration of the Competition. You must be 16 years or older to enter into this Competition. If you are not 16 you MUST NOT enter into this Competition. If you are 16 or over but have not yet reached 18, you must obtain your parent or guardian’s permission before entering into this Competition. We may ask you to confirm your age if we think it is necessary.

2. This Competition starts at 6am on July 9th 2007 and closes at 12 midnight on December 31st 2007.  To be eligible for a Raindance Film Festival Prize noted in Paragraph 10 below, entries must be submitted before 9am on 17/12/2007.

3. This Competition may only be entered through the SkyCast website at www.skycast.com.

4. To take part in this Competition, entrants must:

o Review the competition Entry Criteria (available at www.skycast.com/greenshoots);
o Make an original short film (60 seconds long) on climate change action: things people can do, things    people are already doing, or funny and creative ideas for being climate friendly ;
o Upload it to SkyCast and tag it “Greenshoots” ;
o Provide contact details, including the entrants full name, phone number, and email address.
o Comply with the SkyCast Usage Policy and the Terms and Conditions of this Competition (“Competition Terms   and Conditions”);
o Entrants may submit more than one entry/short film ;
o Entries must not be sent in through agents or third parties.

Each eligible entry will be automatically entered into the Competition. Sky does not accept responsibility for network, computer hardware or software failures of any kind, which may restrict or delay the sending or receipt of your entry.

5. Other than as set out in paragraph 6 and 7 below, the SkyCast Usage Policy available at www.skycast.com/info/pgterms shall be applicable to all materials and content submitted for this Competition. Sky reserves the right to disqualify any entrants and their submissions if they fail to comply with these Competition Terms and Conditions set out herein and/or the SkyCast Usage Policy.

6. Paragraph 6.3 of the SkyCast Usage Policy shall be deleted and replaced by the following:

"6.3
(a) This 6.3 (a) will apply to the Winner (as defined in paragraph 10 of the Competition Terms and Conditions) of the Competition.

From the time you submit your Content (short film) to the Service you are giving Sky and any other members of the British Sky Broadcasting Group an exclusive, perpetual, royalty–free, transferable, right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, display, make available to the public, broadcast, transmit the Content by all forms of media, including via third parties selected by Sky, now known or later invented throughout the world for the full term of copyright and all reversions, extensions or revisions of such copyright. You waive all moral rights in relation to your Content. You further acknowledge and agree that no royalties or fees are payable for use by Sky of the Content. If you are not the owner of these rights and do not wish to give Sky and members of the British Sky Broadcasting Group these rights then do not submit your Content to the Service."

(b) This 6.3(b) applies to all entrants of the Competition except the Winner.
 From the time you submit your Content (short film) to the Service you are giving Sky and any other members of the British Sky Broadcasting Group an exclusive (but only exclusive until after the announcement of the Competition Winner), perpetual, royalty–free, transferable, right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, display, make available to the public, broadcast, transmit the Content by all forms of media, including via third parties selected by Sky, now known or later invented throughout the world for the full term of copyright and all reversions, extensions or revisions of such copyright. You waive all moral rights in relation to your Content. You further acknowledge and agree that no royalties or fees are payable for use by Sky of the Content. If you are not the owner of these rights, and do not wish to give Sky and members of the British Sky Broadcasting Group these rights then do not submit your Content to the Service.

7. Paragraph 6.4 of the SkyCast Usage Policy shall be deleted and replaced by the following: “6.4 By submitting your Content to the Service you acknowledge and agree that you are giving Sky, all other members of the British Sky Broadcasting Group and each User a non-exclusive licence to access your Content through the Service and to view such Content as permitted through the functionality of the Service and under these Terms of Use.”
You agree that your entry does not breach any third party’s intellectual property rights (meaning any existing or future intellectual property rights including (but not limited to) copyright, design right, registered design right, patent, performer’s property right, trade mark (registered, pending or unregistered), database right or any similar right exercisable in any part of the world, including any goodwill or business reputation subsisting therein, for the full term of such rights, and including any applications for registration of any of these).  You also agreed that you have sought all consents from participants within your entry for use of their imagery as contemplated within this competition.

8. Sky will not accept submissions that brings Sky or its partners and affiliate companies into disrepute. Sky views climate change as a serious problem faced by society. This Competition serves to highlight the issue. Sky will exclude from the Competition (in its sole discretion), as not being in the spirit of the Competition footage/content which:

o promotes irresponsible behaviour towards climate change or the planet; and/or
o suggests climate change is not a problem faced by society, caused by humans; and/or
o criticises governments, corporations or individuals for getting involved and trying to tackle the issue of  climate change; and/or
o is otherwise unrelated to the issue of climate change, offensive or inappropriate; and/or
o breaches a third party’s intellectual property rights, in Sky’s reasonable opinion.

9. Sky reserves the right to disqualify any entrants and their submissions if they fail to comply with these  Competition Terms and Conditions and/or the SkyCast Usage Policy.

10. On Monday the 17th of December 2007, 5 entries will be selected at random and will each be awarded a selected Raindance Film Course (winner’s may choose between the Director’s Foundation Certificate or the Filmakers Foundation Certificate).  Each course takes place one night per week, during 5 consecutive weeks, in London.  Winners will be responsible for their own transport to and from the course and expenses.  Course dates shall be agreed in co-ordination with winner’s and course availability, but in any event shall be taken within 12 months of award of the prize.  Selection shall not be an indication as to the quality of the entry or its standing in the overall competition.  Winners of the Raindance Film Prize will still be eligible for the overall prize (noted in Paragraph 12 below).

11. In January/February 2008, one overall winner will be selected by a judging panel comprising Sky executives and external experts on the climate change and figures from the world of film, from all eligible entries.

12. The winner will be contacted within 14 days of the judging panel’s decision.

13. The prize the overall winner will receive is as follows;

• their winning short film featured on a premiere programme to be broadcast on Sky TV. Time, date, and   prominence shall be within Sky’s sole discretion; and
• a “Dream Eden Eco Break” for two people at The Eden Project in Cornwall, valued at £2000.  This consists   of two first class train travel to the Eden Project from within the UK on a Friday night. On arrival the   winner and partner will be picked up by green limousine (to be used for all Cornwall travel) and delivered  to a five star hotel in Fowey/Watergate Bay where they will enjoy a dinner made of locally sourced food   (includes one bottle of wine). On Saturday the winner and partner will get a behind-the-scenes-tour of The  Eden Project and lunch with some of The Eden Project green gurus. The afternoon will consist of another   green adventure such as fishing or surfing lesson (to be confirmed with the winner). Dinner for Saturday   night will be at Fifteen in Cornwall. Winner and partner will return home by train on Sunday.
 The Dream Eden Eco Break for two people must be taken within one year of being notified of winning and all  correspondence regarding logistics of the prize will be between the winner and The Eden Project. Other   expenses not included in the package (such as extra food and beverages) are to be covered by the Winner.

14. There is no cash alternative for the Prizes (or any part of them). The Prizes are not transferable.

15. Except in the case of death or personal injury caused and so far as is permitted by law, Sky and its  associated companies and agents exclude responsibility and all liabilities arising from any postponement,  cancellation, delay or changes to the prize details beyond Sky's control and for any act or default of any  travel company, airline, hotel or any other third party supplier.

16. Sky's decisions are final and legally binding on all entrants. No correspondence will be entered into.

17. If Sky is not able to contact a winner, or a winner is not able, for whatever reason, to accept their   prize, then Sky reserves the right to award the prize to another entrant.

18. Details of winners names and countries of residence will be available for one month after the winning  footage has been aired on Sky by writing to Green Shoots Competition at Sky’s address below.

19. The names, counties and photographs of winners may be used for post-event publicity purposes. The  footage/content submitted may be used by Sky in accordance with the SkyCast Usage Policy and these  Competition Terms and Conditions.

Be inspired by Going Green.The winning Sky Green Shoots short film competition is ‘Going Green’ by Tony Moon.

Thank you to all those who entered Sky’s short film competition Green Shoots, to inspire Sky’s 8.7 million subscribers to become more climate friendly. ‘Going Green’ by Tony Moon was judged the best film to inspire Sky viewers on instant impact activities to tackle climate change within its creative and innovative storyline and quality film making. The films voted as runner up to Going Green were Small Changes and It May Help.
